Already in California Penal Code 187, we define murder to include killing the preborn embryo or fetus unless a woman or abortionist decide they want to kill that child. This petition seeks to be consistent with the treatment of murder and will establish equal justice for the preborn by prosecuting all who would murder them. The initiative is about equal protection under the law for preborn babies, and it eliminates the consent to kill a preborn child without fear of prosecution.

The Petition Defies Roe v. Wade

Roe v. Wade is mere judiciary opinion and does not take precent over law

How did it come to be that California is ruled, ultimately, even by the most unjust decisions of the United States Supreme Court? Simply, because in the case of 1973's Roe v. Wade, rather than act as a check and balance to tyranny, California never simply ignored the court's opinion, nor defied it. Rather, we capitulated and conformed our statutes to abide by it, and we have subsequently never corrected the injustice of a lawless judiciary.

We'd like to think that if the Supreme Court ruled that the government may take our guns, our land, or our born children, that we would never agree to such an opinion of the court. So, why have we thrown tens of thousands of California preborn children to destruction by abortion since 1973?

With this ballot initiative, we the people of California will correct the injustice and oppression that has befallen the preborn. The petition clears from the books all of the prolife laws written over the past several decades. There will be no exceptions for rape and incest, since the baby should never pay for the crimes of the fathers. The traditional exceptions for abortion when the life or health of the mother are threatened have been eliminated as well. Instead, we the people will place on the medical profession an expectation that they will honor the Hippocratic oath and never kill one person to save another, but will attempt to rescue both patients. If the baby dies naturally as attempts are made to save the life of a mother, then that is a tragedy, not a crime.

The success of the initiative will depend not on a change of the Supreme Court, but our standing with our state government to defy the lawless opinion of an out of control judiciary that would allow us to murder our children under the color of law.
